THE POOR LEGAL PROTECTION OF FINNISH CITIZENS.Finland weakens the confidence in the European Court of Human Rights (ECHR).Press Release 20.04.2007
FACTS A. Finland nominated Päivi Hirvelä - who had written things about her legal career in her CV that are not true - as candidate for the post as judge to the ECHR. The national selection panel ( Chancellor of Justice Paavo Nikula, Supreme Court President Pauliine Koskelo, Supreme Administrative Court President Pekka Hallberg, Secretary General of the Ministry of Justice Kirsti Rissanen, Chief of the Juridical Department of the Ministry for Foreign Affairs Irma Ertman and Secretary from the Juridical Department of the Ministry for Foreign Affairs MS Camilla Busck-Nielsen ) as well as the Minister for Foreign Affairs Erkki Tuomioja knew this and approved it. Note! The selection panel was composed by those whom people in Finland file complaints against at the ECHR. ( Read Press Release November 3:rd 2006 ) B. For this Finland awarded the Chief of the Juridical Department of the Ministry for Foreign Affairs Irma Ertman by nominating her as ambassador to the Finnish Permanent Representation to the Council of Europe (Helsingin Sanomat 08.02.2007).C. The President of Finland Tarja Halonen has also approved the way Päivi Hirvelä applied for the post as judge to the ECHR by nominating her as arbitrator to the OSCE Court in Geneva 13.4.2007. Among others the following parties have been informed about the practices of state prosecutor Päivi Hirvelä and the state of Finland: 1. The Council of Europe, the President of the Parliamentary Assembly, René van der LINDEN,2. Former president Mr Luzius WILDHABER and present President Mr Jean-Paul COSTA of the European Court of Human Rights 3. The Commissioner for Human Rights, Council of Europe, Thomas HAMMARBERG. Despite all the information given Ms Päivi Hirvelä that aplied for the job with a falsified English CV was able to start as judge in the ECHR January 1:st 2007. ( Read Press Release February 3:rd 2007 ) The parties informed have not answered to the letters sent to them. Finnish citizens are concerned about their legal protection in the ECHR since the complaints of Finnish people are not translated to other langauges and judges must rely on a referral of the case done by Finnish personnel.
